Following a career break, Lucy has been back at the bar for just over 5 years, during which time she has built up a busy practice concentrating on immigration, housing and police matters.

During the pandemic she worked on secondment to the Welsh Government (Care Inspectorate Wales) in a major inquest into mistreatment and death in care homes.
She has also worked for Welsh Government advising on consequential legislative amendments arising out of the coming into force of Renting Homes (Wales) Act 2016, and thereafter advised a number of social landlords in the drafting of converted occupation contracts for their many thousands of tenants affected by this legislation.
She has developed a broad practice in police work, liaising with officers in complex and high value account freezing and forfeiture orders in a variety of challenging circumstances, as well as navigating the balance to be struck in factually disputed and challenging stalking protection orders, and has appeared in contested applications.

She has also advised on matters of unlawful arrest.

She has a busy and broad practice across all areas of immigration work both First Tier and Upper Tribunal, and judicial review, including urgent applications in respect of imminent deportation. She works as a presenting officer for the Secretary of State, and is instructed off panel by the Government Legal Department in matters of unlawful detention and judicial review.

She frequently  works with vulnerable and challenging clients, and has worked  with clients who lack legal capacity in both immigration and social housing matters.

Lucy is instructed across a broad range of immigration matters.

She regularly appears in human rights claims including partner/spouse applications, dependent parents, dependent children and refugee family reunion.

She has been instructed in more complex challenges including revocation of Indefinite Leave to Remain (judicial review) and Revocation of Citizenship. She is regularly instructed in deportation matters, including urgent applications within 48 hours or less of the deportation directions.

She is instructed in asylum appeals across a range of factual and legal circumstances and enjoys the challenge of dynamic shifts during the course of appeal hearings.

Lucy is always willing to review any First Tier decision and regularly drafts grounds of appeal and appears in the Upper Tribunal.

Lucy has acted in judicial review applications relating to unlawful detention, deportation, rejection of Further Submissions, Certification of claims as clearly unfounded and treatment of an asylum claim as withdrawn

Cases 

  • Acted for the Secretary of State in a claim for unlawful detention, including advising on quantum, for a vulnerable adult, including the question of whether tagging whilst on bail was proportionate in the circumstances
  • Acted for a claimant in judicial review of the revocation of his Indefinite Leave to Remain on the basis of deception
  • Acted for a person convicted of rape, successfully challenging a deportation order in both the First Tier Tribunal and resisting the appeal of the Respondent to the Upper Tier Tribunal
  • Successful appeal to the Upper Tribunal in a case based on homosexuality where the FTT judge employed improper reasoning
    Instructed by the Secretary of State as co-presenting officer in appeal related to multiple family members, currently residents of Gaza, seeking to join family in the UK.

Lucy has acted in a wide array of police applications ranging from dog destruction orders and property applications to complex closure orders, account freezing and forfeiture orders and stalking protection orders, as well as advising on matters of unlawful arrest
Cases 

  • Represented the police in complex closure order with multiple defendants where the matter was discontinued with no order for costs after a partial hearing.
  • Account forfeiture order of significant value secured in complex circumstances where potential issues of exploitation of highly vulnerable victims
  • Successful contested stalking protection order albeit worst behaviour had abated
  • Advised and acted in complex stalking protection order application where issues in consideration also the subject of fact finding in the family court; interim order discharged, no final order sought.
  • Advised on liability and quantum in unlawful arrest claim where claimant had previous settled claim in similar circumstances.

Lucy regularly acts in possession proceedings, often based on rent arrears and/or anti-social behaviour, and works to achieve the best possible outcome for tenants whose homes are at risk.

She also appears in injunctive and committal proceedings

She is familiar with and frequently pleads claims arising out of failure to provide occupation contracts and other documentation to tenants which can give rise to considerable damages.

  • Represented a client with severe hoarding issues and at risk of self harm, working to ensure that re-possession of their home was delayed as far as possible and sensitively managed
  • Settled claim for significant arrears with deferred period for departure
  • Advised in possession claim where housing benefit claim partially thwarted by landlord, leading to significant arrears. Settled with extended period for departure, arrears remitted.
