Kate Parker, barrister at Civitas Chambers, highlights the ‘unusual’ Court of Appeal judgement in Simmons v Castle [2012] EWCA Civ 1039 on an application to approve a settlement of an appeal in a hearing rather than simply in writing.

 In the words of the Lord Chief Justice, the hearing provided ‘an appropriate opportunity to announce an increase in general damages in most tort actions with effect from 1 April 2013’.
